FTF UPDATE ON
QUARANTINE PROPOSA
TALLAHASSEE The first draft of a bill that would provide sweeping legal protections to gay persons and others who might be suspected of being HIV infected emerged from a legislative committee on March 3rd.
Many important legal safeguards in the proposal were added after intensive analysis and lobbying by Florida Task Force (FTF) lobbyist Charlene Carres under the direction of FTF Chair Jon Klein..
The bill was the work of a committee chaired by Representative Lois Frankel of Palm Beach County.
"We are pleased with the proposal," said Klein. "It contains top anti-discrimination provisions that would protect members of our community from unfair treatment by employers, insurance companies, governmental agencies and school boards.".

The current proposal includes:
a provision forbidding employers from discriminating against a person solely because he or she is suspected of being HIV infected;
a section making it illegal for insurance companies in most instances to deny or cancel insurance of persons with AIDS or persons in high-risk groups;

a provision forbidding school boards and other governmental agencies from denying persons with AIDS access to any facility or program in most instances;

strong new programs designed to educate medical professionals, teachers, students and many other groups about the methods by which HIV is transmitted;

test.
Also included in the bill is a controversial proposal allowing the state to confine some persons who "knowingly and deliberately spread" HIV. The current draft includes very strong legal protections that will prevent the state from confining anyone unless clear and convincing evidence exists that he or she is HIV infected, is deliberately spreading it to others and that counseling has failed to prevent this behavior.
"Naturally, we are all concerned about this provision," said Klein, "but we feel that the safeguards in the bill will protect members of our community better than the laws currently on the books. Few people are aware, but in 1986 the legislature enacted one of the most severe quarantine laws in the nation, which essentially allows the state to confine persons with AIDS very easily. This new bill is a vast improvement over the current law and something far more beneficial to our community."
The 1986 statute permits the state to quarantine a person with AIDS based upon far less evidence than the current draft. It also contains no anti-discrimination laws, leaving persons in high-risk groups virtually unprotected from unfair treatment.
The Frankel committee is expected to continue working on the current proposal until the full legislature convenes on April 5th.
